1. Payment & Late Fees

Fixed Fees: All project fees are as quoted. A deposit may be required before work begins.
Hosting & Maintenance Billing: Monthly subscriptions are billed in advance.
Right of Suspension: If a hosting or maintenance bill remains unpaid for more than 7 days past the due date, Oakmont Digital reserves the right to suspend website access, take the site offline, or restrict administrative access until the balance is cleared.
Reactivation Fee: We reserve the right to charge a £50 reactivation fee to restore services suspended due to non-payment.

2. The “3-Day Delivery” Promise

Clock Start: The 3-day countdown begins only after we receive all “Starter Content” (Logo, text, images).
Penalty: If we miss the deadline, your 1st year of hosting is free. This is the sole remedy for a delay; Oakmont Digital is not liable for any perceived loss of business due to delivery times.

3. Scope Creep & Revisions

Defined Rounds: Standard packages include 1 revision round; Advanced includes 3.
Out of Scope: Requests for features not listed in the original package (e.g., adding an e-commerce store to a Standard site) will be quoted separately as an add-on.
Final Approval: Once a client gives final approval or the site goes “Live,” any further changes are billed at our standard hourly rate or require a Maintenance Plan.

4. Intellectual Property & Licenses

Client Content: The client guarantees they own the rights to all text and images provided. Oakmont Digital is not liable for copyright infringement resulting from client-provided media.
Portfolio Rights: Unless otherwise agreed in writing, Oakmont Digital retains the right to display the completed website in our “Recent Works” portfolio and marketing materials.
Software Licenses: We may use licensed plugins or themes. While the website is yours, the underlying “Developer Licenses” for certain tools remain the property of Oakmont Digital. If you move hosting, you may need to purchase your own licenses to receive future software updates.

5. Website Content & Legality

Prohibited Content: We do not build websites for businesses involved in illegal activities, hate speech, or adult industries.
Legal Compliance: While we provide a “GDPR Compliant” structure, the client is ultimately responsible for ensuring their business operations and specific privacy disclosures meet local legal requirements.

6. Termination of Service

Client Termination: You may cancel your maintenance plan at any time. No refunds are issued for the current billing cycle.
Agency Termination: Oakmont Digital reserves the right to terminate service if a client is abusive, non-responsive for more than 30 days, or violates these terms.

7. Limitation of Liability

No Guarantees: While we build for high conversion, we do not guarantee specific sales figures or lead volumes.
Technical Failure: Oakmont Digital is not responsible for losses caused by third-party outages (e.g., Google, WordPress core updates, or domain registrars).

8. Local SEO & Search Engine Services

No Guarantee of Rankings: While Oakmont Digital is a “Google Certified Partner” and uses industry-standard “White Hat” techniques, we do not—and cannot—guarantee a specific #1 ranking or a “top 3” position in the Google Local Map Pack. Search engine algorithms are proprietary and change frequently.
Service Scope: Our Local SEO Boost includes:
- Google Business Profile (GBP) optimization.
- Local citation building and management.
- Monthly ranking reports and website maintenance.
Third-Party Platforms: We are not responsible for Google’s decision to suspend, shadow-ban, or remove a business listing due to the client’s past history, Google’s automated policy updates, or the client’s failure to respond to Google’s verification requests (e.g., postcard or video verification).
Content Approval: The client is responsible for reviewing and approving any business descriptions or posts we create for the Google Business Profile. Once published, we are not liable for any inaccuracies provided by the client.
Ranking Fluctuations: SEO results typically take 3–6 months to show significant impact. The client acknowledges that rankings may fluctuate during the optimization process and that Oakmont Digital is not liable for temporary drops in traffic.
Termination of SEO Services: Monthly SEO plans require a 30-day written notice for cancellation. Upon termination, Oakmont Digital will stop active optimization and reporting; however, any optimizations already made to the website or GBP remain the property of the client.
